Figlo website content, including the information, names, images, pictures, logos and icons regarding or relating to Figlo, its products and services (or to third party products and services), is provided "AS IS" and on an "IS AVAILABLE" basis without any representations or any kind of warranty made (whether express or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
To the maximum extent permitted by applicable law Figlo and its suppliers shall not be liable for any indirect, special, incidental, exemplary or consequential damages or for damages relating to telecommunication failures, loss, corruption, security or theft of data, viruses, spy ware or the like, whether based in contract, tort (including negligence), product liability or otherwise, even if Figlo or its suppliers have been advised of the possibility of such damages and even if a remedy set forth herein is found to have failed of its essential purpose. The limitations of damages set forth above are fundamental elements of the basis of bargain between Figlo and you. Figlo would not be able to have provided the service without such limitations.
Figlo does not warrant that functions contained in the Figlo website content will be uninterrupted or error free, that defects will be corrected, or that the Figlo website or the server that makes it available are free of viruses or bugs.
Intellectual Property
Figlo, including its subsidiaries and affiliates reserves all rights with respect to its trademarks, service marks, logos, trade names and other indicia. Figlo does not routinely accept or review specific requests for guidance on the use of its marks. Any unauthorized use of any Figlo-owned mark, or any use of a mark that is confusingly similar to, or likely to cause confusion with, an Figlo-owned mark, would constitute infringement of Figlo’s exclusive trademark rights.
This document does not constitute any form of license to use any Figlo-owned mark. No Figlo employee is authorized to provide guidance on the use of Figlo-owned marks, nor to give permission to use any Figlo-owned mark, except by formal written license agreement published by Figlo (e.g. through one of its membership programs) or signed by an authorized director. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable. These terms shall be governed by and interpreted in accordance with the laws of The Netherlands.
